Terms & Conditions

These Terms & Conditions ("Terms") govern your use of kartday.com and our related services (the "Service"), operated by DataStew LLC ("Kart Day," "we," "us"). By creating an account, registering for an event, or otherwise using the Service, you agree to these Terms. If you're registering or managing an account on behalf of a minor, you're agreeing on their behalf as well as your own. The Service is currently offered only to users in the United States.

What Kart Day Is

Kart Day is a software platform that helps racing organizations run their own leagues and events — registration, scoring, kart and grid management, results, and standings. We don't own or operate any kart track, and we don't supply the karts, equipment, or on-site staff for any event. Each event is organized and run by an independent organization (an "Organizer") using the Service, at a venue of their choosing — not by Kart Day. The Service is also intended to grow into a platform connecting racers with sponsors; as that functionality is introduced, it will be covered by these Terms and our Privacy Policy the same as everything else described here.

Accounts

You need an account to register for events, manage a driver profile, or administer an organization. You're responsible for the accuracy of the information you provide and for keeping your login credentials secure; let us know right away if you think your account has been compromised.

Accounts for minors are requested and set up by a parent or guardian through our family registration process, not created directly by the minor. A guardian is responsible for the accuracy of information on an account they manage and for any activity on it.

Event Registration & Payment

Registering for an event through the Service is a registration with that event's Organizer, not a purchase from Kart Day. Entry fees, refund policies, cancellations, and any payment you make for a race are set and handled by the Organizer, typically through a payment method of their own choosing — Kart Day does not process or store your payment card information. Direct any payment or refund question to the Organizer running the event.

Assumption of Risk

Kart racing is a physical motorsport with an inherent risk of injury, even when run safely and by an experienced operator. Kart Day is not the operator of any track or event, doesn't supervise on-track activity, and isn't a party to whatever liability waiver or release the Organizer or venue requires you to sign before you race. By registering for an event, you acknowledge that racing carries real risk and that you're responsible for following the rules and safety instructions of the Organizer and venue.

Public Information

Event entries, starting grids, live results, and season standings are public by design — that's the point of running a competitive event. A driver's (or their guardian's) choice to make a public profile visible, and which sections of it to show, is handled through account settings described in our Privacy Policy.

Acceptable Use

You agree not to:

• Submit false information, or register using an automated script or bot
• Impersonate another person or misrepresent your affiliation with an organization
• Interfere with the integrity of race results, scoring, or standings
• Attempt to access another user's account or data without authorization
• Disrupt or overload the Service, or bypass its security or bot-prevention measures
• Use the Service for any unlawful purpose

We can suspend or terminate an account that violates these Terms, at our discretion.

Organizations & Their Content

An Organizer is responsible for the events, rules, pricing, and content they publish through the Service for their own organization, and for complying with any law that applies to running their events. Kart Day isn't a party to the relationship between an Organizer and the drivers who race in their events.

Your Content

You're responsible for the content you add to your profile — your bio, social links, and similar information. By adding it, you give us permission to display it on the Service consistent with your visibility settings. Don't post anything you don't have the right to share, or anything unlawful, harassing, or misleading.

Intellectual Property

The Service itself — its design, code, and branding — belongs to Kart Day/DataStew LLC. Using the Service doesn't give you any ownership in it. Race results, lap times, and similar factual data generated by an event belong to the event record and may be displayed publicly as described above.

External Links

The Service links to third-party sites we don't control — a venue's timing system, an Organizer's payment page, or a driver's social media. These Terms don't cover those sites, and we aren't responsible for their content or practices.

Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, error-free, or that any particular event, result, or ranking will be accurate or available at all times.

Limitation of Liability

To the fullest extent permitted by law, Kart Day and DataStew LLC aren't liable for any indirect, incidental, or consequential damages arising from your use of the Service, or for any injury, loss, or damage arising from an event, venue, or Organizer's conduct — Kart Day is a registration and scoring platform, not the operator of the race itself. Our total liability for any claim relating to the Service is limited to the amount you paid us directly, if any, in the twelve months before the claim arose.

Indemnification

You agree to indemnify and hold Kart Day and DataStew LLC harmless from any claim arising from your violation of these Terms, your misuse of the Service, or your participation in an event.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service must be brought in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction there.

Changes to These Terms

We may update these Terms as the Service changes. If we make a material change, we'll update the date at the top of this page and, where appropriate, let registered users know. Continuing to use the Service after a change means you accept the updated Terms.
